🌪️ Severe Weather Impacts Freight. This week, the U.S. is facing a meteorological mix that could throw freight movement into chaos. A historic snowstorm is set to smother the Western U.S., potentially piling up to ten feet of snow in places, with critical interstates like I-80 and I-5 facing imminent shutdowns. Plus, many passes can see up to 100 mph winds. Farther south, Texas and Oklahoma are grappling with massive wildfires, disrupting travel and prompting evacuations. And in the Midwest, Chicago's suburbs felt the fury of tornadoes touching down throughout the evening on Tuesday.

🍋 A Truckload of Cocaine. At the Otay Mesa border, a seemingly ordinary shipment of Persian limes was anything but. Upon a secondary inspection of the trailer, prompted by a K-9 unit, officers unearthed a stash: 158 packages of cocaine, hidden among the fruit, weighing 435 pounds and valued at over $3.3 million. This sour discovery is another big win for Operation Apollo, a concerted effort to combat the spread of fentanyl and other dangerous narcotics. The bust is the latest showing the creative lengths smugglers will go to.

🤖 Autonomous Reefer Route. Kodiak Robotics and Martin Brower are testing autonomous reefer deliveries from Roanoke, Texas, to Oklahoma City. Since kicking off in July 2022, their venture has completed over 600 trips, and this reefer route expands offers hinting at service to giants like McDonald's and Chick-fil-A. Through Kodiak’s Partner Deployment Program, the duo aims for complete vehicle autonomy by year's end.

The Most Important Case in US Logistics

"This is the most important case in US logistics right now," says trucking industry legal expert Matthew Leffler. The focus is a $100M "nuclear verdict" against Werner Enterprises.

The Incident: The case centers around a tragic accident that occurred on December 30, 2014, when a pickup truck skidded on black ice on Interstate 20 in West Texas, crossing the median and colliding with a Werner truck. This accident led to fatalities and severe injuries, sparking a lengthy legal battle.

The Verdict: The main point of the argument revolved around the assertion that Shiraz Ali, Werner’s driver, failed to adequately reduce his speed given the hazardous weather conditions. They contended that had Ali slowed down, the trajectory of the events might have been different, possibly preventing the collision when the pickup crossed into the opposing lane.

After years of litigation, a court decision in 2018 awarded nearly $90 million to the plaintiffs, the family involved in the crash. This amount has since increased to over $100 million with interest as the case moved through the appeals process.

Werner and their legal team's defense highlighted the unpredictable nature of the accident. They said it was unreasonable for Ali to expect the pickup truck's sudden and unforeseen intrusion into his path.

So it raises the question: what is the extent of a driver's responsibility to anticipate and lessen the risks of unforeseen hazards?

Appeals Process

  • First Appeal: Werner Enterprises contested the 2018 verdict, leading to an appeal.
  • Court of Appeals: The Court of Appeals for the 14th District of Texas took the case, ruling 5-4 in favor of the plaintiffs, upholding the lower court's decision.

Current Developments

  • Supreme Court Review: The focus now shifts to the Texas Supreme Court, where Werner has sought a review of the appellate court's decision.
  • Deadline for Briefs: The Supreme Court has set a deadline for all final briefs to be filed by March 6. This includes submissions from both Werner's legal team and the plaintiffs, as well as any amicus briefs from interested parties like the Texas Trucking Association.
  • Next Steps: After the March 6 deadline, the Texas Supreme Court will decide whether to take up the review. This decision could significantly impact the case's outcome and potentially set new legal precedents for the trucking industry.

  • Setting Precedents: The ruling against Werner Enterprises is monumental, not just for the sum involved but for the potential precedents it sets regarding carrier liability and the expectations placed on drivers amidst unforeseen circumstances.

  • Expanded Definitions of Negligence: Brokers may find themselves at risk of being held liable for negligence in cases where their role in selecting and managing carriers is found to be lacking.
  • Contracts: To mitigate potential liability, brokers may revise agreements, leading to more stringent requirements for carriers and more detailed contracts.

A Similar Case Settled

The industry has seen a trend in "nuclear verdicts," where damages exceed $10 million, painting a worrying picture for the future of trucking operations and their insurance protocols. This case follows closely behind another for Werner.

  • Werner settled a lawsuit for $150 million in 2022 related to a crash in 2020 near Sulphur Springs, Texas. The tragic accident involved a Werner truck colliding with a parked vehicle on Interstate 20, resulting in the deaths of two children. Though investigating officers placed no fault on Werner or its driver, the parents of the children filed a lawsuit against the company. In order to avoid the risk of a nuclear verdict, Werner settled.
